Promotion Terms and Conditions: Kumho Merlin Pass Promotion – MT1

  1. This is a Promotion run by Kumho Tyre UK Ltd (company number 01331860) whose registered office is at Suite 6, Hilton House, Corporation St, Rugby CV21 2DN (the “Promoter”).
  2. The Participating Retailer is: Merityre Specialists, 33a Westway, Walworth Business Park, Andover, Hampshire, SP10 5JG.
  3. By participating in this Promotion all participants will be deemed to have accepted and be bound by these terms and conditions.
  4. The Prize is up to four Merlin Gold Passes that will be valid for up to one year. Details and Terms and Conditions of the Merlin Gold Pass can be found on the Merlin Pass website (the supplier of the prize.)
  5. By participating in this Promotion, and in the event of winning, participants will be deemed to have accepted and be bound by the terms and conditions of the supplier(s) of the prize.
  6. The Promoter shall not be liable, whether in contract, tort (including negligence) or otherwise for any damage which was unforeseeable or for indirect, consequential or economic losses or loss of profits arising as a consequence of this Promotion.
  7. You shall indemnify the Promoter against all costs claims and losses arising from your participation in the draw and your use or your non-use of the Prize.

1.    The Promoter is not responsible for any changes to the terms and conditions of the Merlin Gold Pass.

2.    The Promoter is not liable for any incidental or further expenses incurred by the winner associated with the Merlin Gold pass for example (but not limited to) travel costs, or food costs.

  1. The Promoter reserves the right to amend, suspend or cancel the Promotion where it becomes necessary to do so.
  2. The Promoter reserves the right to substitute the Prize with another prize of its choosing which has, in the Promoter’s opinion, a value the same or greater than the original prize, in the event of circumstances outside of its control.
  3. The Promoter does not accept any responsibility for any technical or functional issues arising with the Prize and does not provide any warranty in relation to the Prize. Any issues with the Prize should be referred directly to the supplier of the Prize.
  4. The Promoter reserves the right to withhold any Prize.
  5. The Promoter reserves the right to change these terms and conditions at any time. The changes will be valid from the date they are published.
  6. The Promoter reserves the right to cancel or make changes to the Promotion at any time without notice.
  7. The Prize is non-transferable. Only the person who made the original entry can be awarded the Prize.

15.  There is no cash equivalent either in whole or in part. By way of example, a cash equivalent will not be paid should the winner request three Merlin passes instead of four.

  1. The Prize may not be re-sold.
  2. The name and county of the winner may be requested by sending a stamped addressed envelope to the Promoter.
  3. Any dispute arising out of or in connection with this Promotion shall be subject to English law and the Courts of England and Wales shall have exclusive jurisdictions
  4. This Promotion has a purchase requirement:
    1. This Promotion is open only to retail customers of the Participating Retailer who are aged over 18 years on the date of purchase.
    2. Entrants must purchase, and have fitted by the Participating Retailer, at least 2 Kumho brand PCR or LTR tyres in a single transaction during the Promotion Period and must submit an entry to the draw before the closing date for entries.
    3. Where the purchase is made in-store, all tyres must be fitted at time of purchase. Where the purchase is made online, a fitting appointment with the Participating Retailer must be booked at the time of purchase and the tyres must be fitted by the Participating Retailer before the Promotion End Date.

20. This Promotion is time limited:

1.    The Promotion Period is:

1.    Start date: 1st April 2024 till 23:59hrs on

2.    End Date: 30th April 2024

3.    Last date for entries: 23:59hrs on 7 May 2024.

  1. The Promotion is not open to:
    1. Employees and their immediate families of the Promoter.
    2. The Promoter’s agencies, their subsidiaries, their immediate families or agents.
    3. Fleet companies.
    4. Employees and their immediate families of the Participating Retailer.
    5. Company vehicle drivers and business and account customers of the Participating Retailer and or the Promoter.
    6. Anyone else connected with the creation and/or administration of this Promotion.

 

22. To enter:

1.    Entry into this Promotion cannot be made other than strictly in accordance with these terms and conditions.

2.    Lost, incomplete, invalid, illegible, fraudulent and/or late claims will not be accepted.

3.    The Promoter reserves the right to refuse a claim if it believes the claim is fraudulent, not legitimate or not valid. The Promoter’s decision is final and is not open to challenge.

4.    Scan the QR code on promotional material pertaining to this draw or visit www.merityre.co.uk or www.winwithkumho.co.uk/merityre

1.    Complete the form with all requested details.

2.    Upload a photo of your receipt from the Participating Retailer which must legibly show:

1.    the details of all the tyres purchased (brand and type) during the transaction

2.    the registration of the car to which the tyres were fitted

3.    the date purchased

4.    the point of sale from which the tyres were purchased and fitted.

5.    Confirm you opt in to the draw by checking the opt in checkbox and submit the form by clicking the submit button.

6.    The Promoter will not contact an entrant to alert them to any flaw with their entry and is under no obligation to do so.

5.    All customers which submit the correctly completed form with the opt-in checked and with a legible and valid proof of purchase will form part of the prize draw for up to 4 Merlin Gold passes.

6.    All information received will become the property of the Promoter.

23. The Draw:

1.    Each valid entry will be automatically numbered and the winner will be chosen at random within 14 days of the Last Date for Entries.

    1. Only the person who made the original entry can be awarded the Prize. The Prize may not be re-sold.

3.    The Promoter will send a Notification of Win Email to the email address of the winner within 7 days of the draw.

1.    Should the Notification of Win Email bounce back to the Promoter or be reported as undeliverable by the Promoter’s system the prize draw will be repeated, a new winner will be chosen at random, and no further communication with the owner of the email that bounced back will be entered into. This process will repeat until a notification is successfully sent.

      1. The Promoter is not liable for a participant failing to act upon the Notification of Win Email that might have entered the participants spam or junk folders or was otherwise not noticed or overlooked by participant.

4.    The winner must contact the organiser, using the same email to which the Notification of Win Email was sent, within 7 days of the Notification of Win Email being sent by the Promoter to claim the prize.

1.    Should the winner fail to reply to the Promoter within 7 days of the Notification of Win Email being sent by the Promoter, the prize draw will be repeated; a new winner will be chosen at random; and no further communication with the winner who does not claim the Prize will be entered into. This process will repeat until the Prize is successfully claimed.

 

5.    Should a winner decline the Prize for any reason the prize draw will be repeated.

6.    Once claimed, the Prize will be sent by the Promoter to the address entered on the entry form.

7.    The Promoter is not responsible for activating or renewing the passes.

    1. No responsibility can be accepted by the Promoter for any Prize that is damaged or lost in the post.

Personal Data Statement: By entering the Promotion, all entrants acknowledge that their personal data will be used by the Data Controller for the purposes of the administration of this promotion only, including contacting winning entrants. Entrants also acknowledge that when a third party asks for confirmation of a winner of a competition a promoter is required to provide the name of that winner and the county that he or she lives in. Personal data collected is being collected by the Promoter solely to manage and administer the Promotion, issue the prize gift card and to verify the information provided.

Participants accept that the Promoter will submit information entered on the online entry form to a third party (Pineapple, Studio 1, Trinity Court, Stoke Road, Bromsgrove, B60 3EQ) so they can validate the information provided, confirm the identity of the claimant, and assist the Promoter to issue the prize in accordance with the Promotion.

Your data will be processed based on your agreement to the Promotion terms and conditions and will be retained for only as long as is sufficient to administer this Promotion.
